1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of www.shoplinka.com (“Shoplinka.com”, the “Platform”, “we”, “us”, or “our”).

The Platform is owned and operated by Chez Comfort (Pty) Ltd, Registration Number 2024 / 510554 / 07, trading as Shoplinka.com.

By accessing, registering on, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Returns & Refunds Policy.
If you do not agree, you must immediately stop using the Platform.


2. The Marketplace Model

2.1 Role of Shoplinka.com

Shoplinka.com provides a multi-vendor digital marketplace infrastructure. We facilitate the connection between Customers and Vendors but are not the seller of record for products listed by Vendors.

2.2 No Partnership

Nothing in these Terms creates a partnership, joint venture, agency, or employer–employee relationship between Shoplinka.com and any Vendor. Vendors operate as independent sellers.


3. Vendor Obligations & Product Listings

3.1 Legal Compliance

Vendors must ensure that all products and listings comply with the Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECTA).

3.2 Accuracy of Listings

Vendors must provide accurate product descriptions and high-quality images.
Misleading pricing, false “original prices,” or fake discounts are strictly prohibited.

3.3 Prohibited Items

Vendors may not list:

  • Counterfeit or pirated goods

  • Regulated or illegal substances

  • Products infringing third-party intellectual property rights

Shoplinka.com reserves the right to remove any listing or suspend a Vendor account without prior notice.


4. Orders, Payments & Financial Terms

4.1 Contract of Sale

A binding contract of sale is formed directly between the Customer and the Vendor once an order is confirmed.

4.2 Payment Processing

All payments are processed via secure third-party payment gateways.
By using the Platform, you agree to the applicable terms and conditions of these payment providers.

4.3 Commission & Vendor Payouts

Shoplinka.com earns a pre-agreed commission on each successful sale.
Vendor payouts are processed in accordance with the applicable Vendor Agreement.


5. Shipping, Delivery & Risk

5.1 Delivery Responsibility

Vendors are responsible for the proper packaging and dispatch of goods.

5.2 Risk of Loss

Risk of loss or damage passes to the Customer upon delivery.
Shoplinka.com is not liable for items lost, delayed, or damaged by third-party couriers.

5.3 Tracking

Vendors must provide valid tracking information via the Platform within the specified lead time.


6. Returns, Refunds & Cancellations

6.1 Statutory Rights

All Vendors must comply with:

  • The 7-day cooling-off period for online purchases (ECTA), and

  • The 6-month implied warranty for defective goods (CPA)

6.2 Returns Process

Customers must initiate return requests through the Platform.
Shoplinka.com facilitates communication, but the Vendor is responsible for:

  • Accepting returned goods

  • Covering return costs for defective products, where applicable


7. Data Protection (POPIA)

7.1 Privacy Compliance

Shoplinka.com processes personal information in accordance with the Protection of Personal Information Act (POPIA).

7.2 Vendor Use of Customer Data

Vendors receive Customer information (name, address, and phone number) solely for order fulfilment purposes.

Vendors are strictly prohibited from:

  • Using Customer data for unsolicited marketing

  • Sharing Customer data with third parties


8. Dispute Resolution

8.1 Internal Resolution

In the event of a dispute between a Customer and a Vendor, the parties agree to first attempt resolution through Shoplinka.com’s internal dispute process by contacting [email protected].

8.2 No Arbitration

Shoplinka.com facilitates communication only and is not an arbitrator.
If no resolution is reached, the parties must pursue independent legal remedies.


9. Limitation of Liability & Disclaimers

9.1 “As Is” Basis

The Platform is provided on an “as is” and “as available” basis.
We do not guarantee uninterrupted or error-free operation.

9.2 Exclusion of Damages

To the maximum extent permitted by law, Shoplinka.com shall not be liable for any indirect, incidental, or consequential damages arising from:

  • Use of the Platform, or

  • Products sold by Vendors

9.3 Liability Cap

Shoplinka.com’s total liability for any claim shall not exceed the commission earned on the transaction giving rise to the claim.


10. Termination of Use

We reserve the right to suspend or terminate access for any User or Vendor who:

  • Violates these Terms

  • Provides false or misleading information

  • Engages in off-platform transactions to avoid fees

  • Receives consistently poor ratings or excessive return rates


11. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
All disputes are subject to the exclusive jurisdiction of South African courts.
